This software is provided 'as-is', without any express or implied warranty. In no event will the authors be held liable for any damages arising from the use of this software.

Permission is granted to anyone to use this software for any purpose,including commercial applications, and to redistribute it freely, subject to the following restrictions:

1. The software is licensed, not sold. This agreement only gives you some rights to use the software. Eloquera reserves all other rights. Unless applicable law gives you more rights despite this limitation, you may use the software only as expressly permitted in this agreement. In doing so, you must comply with any technical limitations in the software that only allow you to use it in certain ways. You may not
• disclose the results of any benchmark tests of the software to any third party without Eloquera’s prior written approval;
• work around any technical limitations in the software;
• reverse engineer, decompile or disassemble the software, except and only to the extent that applicable law expressly permits, despite this limitation;
• use components of the software to run applications not running on the software;
• make more copies of the software than specified in this agreement or allowed by applicable law, despite this limitation;
• publish the software for others to copy;
• rent, lease or lend the software;
• transfer the software or this agreement to any third party;
• use the Potentially Unwanted Software definitions separately from the software;

2. Any distribution of Eloquera database, including as a part of commercial and non-commercial software, requires written permission from Eloquera.
To obtain a written permission the following information will be required, but not limited to

a) Your company (your name if you are not representing a company)
b) Your company’s primary industry
c) Describe the applications you are developing with the Eloquera DB
d) Estimated number of users for the applications
e) Are you planning to use the Eloquera DB in other applications in the future?
f) Do you consider getting paid technical support for some/any products you use in production?
g) How did you find us?
h) Contact email

Alternatively, if an appropriate online survey is available, to obtain automatic distribution permission survey shall be filled.

3. Companies with revenue $1M USD or greater using the Eloquera Database in the production environment, are required to obtain a minimum Gold support subscription per server per year. For details on options available please contact Eloquera.

4. The origin of this software must not be misrepresented; you must not claim that you wrote the Eloquera database software or its part.

By accepting this agreement, you also agree to be contacted directly by the Eloquera staff on various technical questions related to the use of the Eloquera Database.
Providing false details voids the license for using the Eloquera Database.
